1. Acceptance of these terms

By accessing or using swanseawineandspirits.com (the “Site”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Site. The Site is operated by Swansea Wine & Spirits, Inc.(“we,” “us,” “our”) from 510 Wilbur Avenue, Swansea, MA 02777.

2. Age and legal drinking age

This Site contains information about alcoholic beverages and is intended for adults of legal drinking age. You represent that you are at least 21 years of age and legally permitted to purchase and consume alcoholic beverages in your jurisdiction. We may require age verification at the point of purchase. It is a violation of Massachusetts law to purchase alcohol for anyone under 21.

3. Use of the Site

You agree to use the Site for lawful purposes only and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site. Prohibited uses include, without limitation:

4. Purchases

The Site does not sell alcoholic beverages online. All purchases are made in person at our store at 510 Wilbur Avenue, Swansea, Massachusetts, and are subject to Massachusetts state and local law. Product availability, pricing, and vintages shown on the Site are provided for informational purposes and may change without notice.

5. Special requests and communications

If you submit a special request (for example, asking us to source a specific bottle), we will use the information you provide to respond to your request. Submission is not a purchase order and does not create a binding obligation on either party until we mutually agree on product, price, and pickup. We reserve the right to decline any request.

6. Newsletter and text messages

If you subscribe to our newsletter, we will send occasional emails about new arrivals, tastings, and store news. You can unsubscribe at any time using the link in each email.

Employee text-message notifications are subject to the SMS section of our Privacy Policy. Reply STOP to any message to opt out. Message and data rates may apply.

7. Intellectual property

All content on the Site — including text, graphics, photographs, the Swansea Wine & Spirits name and logo, cocktail recipes we have curated, and the overall look and feel — is owned by Swansea Wine & Spirits, Inc.or its licensors and is protected by U.S. and international copyright and trademark law. You may view the Site for personal, non-commercial use. Any other use — copying, redistribution, republication, or commercial use — requires our prior written permission.

Third-party product names, brands, and logos appearing on the Site are the property of their respective owners and are used for descriptive purposes only.

8. User-submitted content

If you send us feedback, product suggestions, or other content through the Site or by email, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and act on that content for our business purposes. Please do not send us confidential information or content that infringes anyone’s rights.

10. Cocktail recipes and content

Recipes and product descriptions on the Site are provided for informational and entertainment purposes. Please drink responsibly, do not operate a vehicle after consuming alcohol, and never serve alcohol to anyone under 21.

To the fullest extent permitted by law, Swansea Wine & Spirits, Inc. and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Site. Our aggregate liability arising out of these Terms or your use of the Site shall not exceed one hundred U.S. dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless Swansea Wine & Spirits, Inc.and its officers, employees, and agents from any claim, loss, or damage, including reasonable attorneys’ fees, arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Bristol County, Massachusetts, and you consent to their personal jurisdiction.

We may revise these Terms from time to time. The effective date at the top of this page shows when they were last updated. Continued use of the Site after changes take effect means you accept the revised Terms.
